Virginia Makes Third-Party Alcohol Delivery Permanent: New Law Removes Expiration Date
RICHMOND, VIRGINA – March 25, 2025 – On March 21, 2025, Governor Youngkin signed HB 2058, legislation that makes third-party alcohol delivery permanent in Virginia. The law currently allowing third-party alcohol delivery was set to sunset on July 1, 2026, and HB 2058 repeals that expiration, thus making third-party alcohol delivery a permanent option for Virginia retailers and consumers.
Leading up to HB 2058, in 2024, the Virginia General Assembly passed legislation mandating a third-party alcohol delivery work group to take a deeper look at the industry and evaluate compliance. The Adult Beverage Alliance participated in the work group with industry members and other stakeholders. As part of the work group’s mandate, the Virginia ABC’s Bureau of Law Enforcement conducted over 200 minor decoy delivery compliance operations, which coincided with the industry discussions. The operations resulted in a 90% compliance rate on delivery attempts, illustrating that third-party alcohol delivery is a safe and compliant fulfillment option in Virginia.
After the work group, the Virginia ABC published a report for the General Assembly that detailed the group’s findings. “Virginia ABC and the third-party delivery licensees have demonstrated that they can achieve acceptable rates of underage buyer compliance, and it would be appropriate to allow third-party delivery licensees to continue responsible alcohol delivery in Virginia.” The report emphasized the state’s age verification and training requirements, and noted “these features of the third-party delivery licensing system have now enabled third-party delivery providers to reach a level of underage buyer compliance, 90%, at least comparable to rates found during underage buyer operations at brick-and-mortar retailers, at which Virginia ABC has found an 87% year-to-date compliance rate.” Recognizing the improvement of the industry and the commitment to safe and responsible alcohol delivery, the Virginia General Assembly passed HB 2058, removing the repeal of the sunset provision for third-party alcohol delivery.
